Chilean factoring firms file criminal complaint against two executives of Equitas


Juan Ignacio Piña, lawyer and former undersecretary of Justice recently filed a lawsuit against two directors of Innovaciones Forestales. Whilst representing the two local factoring firms Primus Capital and Contémpora, Piña filed the lawsuit against the directors Cristián Shea and Vicente Pérez before the Court of Guarantee of San Pedro de la Paz. The lawsuit was filed for the insolvency offense contemplated in numbers 1 and 2 of article 463 ter of the Criminal Code; this punishes the delivery of false information during the process of reorganisation or liquidation to the seer, liquidator or creditors, as well as the absence of accounting books and their backups.

The complaint was admitted for processing on the 4th of October and an investigation order was sent by the Local Prosecutor’s Office of Concepción.
